Terms and conditions of service
Hosting services
- By logging into your account or uploading files to it
you are accepting these terms.
- Adult, Warez, illegal MP3 Sites or IRC Bots are not
allowed.
- Any form of un-solicited bulk e-mailing or spam is not
allowed.
- Your virtual server (including FTP access) is for
your personal use only. You must not divulge the password to
any other person, and you should take reasonable precautions to ensure
that it is not discovered by other people.
- Data stored on our servers is not guaranteed
to be backed up. It is recommended that you keep an independent backup
of all data stored on your virtual server.
- You may not run server processes (eg. talkers/IRC
Bots) from your virtual server.
- We shall not be held liable for any loss or
damages caused by the use or misuse, unavailability or removal of
services.
- When your account is closed, all files (including web
pages, etc.) will be deleted.
- We reserve the right to cancel your account at any
time without notice.
- To protect your privacy we never distribute your name
or e-mail address to any third parties.
- You may not exceed your allotted disk space
allocation.
- Hosting must be paid for annually in advance.
Refunds
- You may cancel your order within 7 days from when
the contract is concluded, without giving a reason. If you exercise
your right to cancel, we will then return your money within 7 days of
cancellation.
- If you cancel your account within your service period
then we will not make any refunds on any unused portions of
your account, other than cancellation within the guarantee period when
a full refund will be made.
Bandwidth
- Each virtual server includes a nominated amount of
bandwidth. If you use more than this amount then you agree to pay for
this bandwidth at a rate of 5p (five pence) per 1 MB.
- If your bandwidth reaches the point where it has an
adverse affect on other clients we reserve the right to disable your
site until you can reduce your bandwidth usage.
Web Pages
- Commercial use of web and ftp space is
permitted.
- You will be held responsible for and accept
responsibility for any defamatory, confidential, secret or other
proprietary material available via your pages.
- We reserve the right to remove material deemed
inappropriate from your web pages, without prior notice.
- We do not allow adult, warez, illegal MP3 web
sites or IRC bots on our servers.
Full Hosting Terms
Web Design
- You are responsible for the content of your pages,
including obtaining the legal permission for any works they include
and ensuring that the contents of these pages do not violate UK law.
You the client are the publisher of the website and own the copyright
for all content published in your website, and we the designer are
acting on your instructions in adding content to your website. By asking
us to add material into your website you acknowledge that you have
copyright of that material, or permission to use the material. It is the
client's responsibility to fully research their company name, and any
content, logos, or trademarks, etc., used in the website. The client
also agrees as part of our terms and conditions to absolve and indemnify
Beaufort Web Design Limited of any liability in the use of any such
content in the client's website, and to assume full responsibility for
any violations and legal actions which may arise at any time in the
future.
- A link to Beaufort Web Design Limited will appear at the bottom of
each page of the website, unless agreed in advance.
- Beaufort Web Design Limited's 'coding' of a site remains our
property until payment is received - where the ownership passes to the
client. The client cannot resell the design or parts of it unless agreed
in the contract.
General
- By using our services you are accepting these terms.
- We reserve the right to amend and update these Terms
and Conditions at any time without notice
- We own the copyright on all advertising copy that we provide for
pay-per-click campaigns
- You are responsible for insuring that all advertising copy and web
pages does not infringe any intellectual property rights, including
copyright, patent, trademark, music rights, performance rights,
broadcasting rights or moral rights or any act of passing-off.
- Under no circumstances shall Beaufort Web Design Limited be liable
to the Client for an indirect or consequential loss suffered by the
Client relying on the information included in the works prepared by
Beaufort Web Design Limited including (without limitation) loss of
profit, loss of Contracts or pure economic loss. Any liability is
strictly limited to the direct losses associated with remedial costs of
the work only, not to include claims for delays, out of sequence
working, non productive overtime, award of costs, etc. Liability to any
third party for any reason is specifically excluded unless separately
agreed in writing.
We are not liable to the Client for any loss of sales, revenue, profits,
software, data, or consequential loss.
We are committed to safeguarding your privacy while
providing the highest possible quality of service. We will only use the
information that we collect about you lawfully (in accordance with the
Data Protection Act 1998) and according to the Which?
Web Trader Code of Practice. If you have any requests concerning your
personal information or any queries with regard to these practices please

contact us.
We collect information about you for two reasons:
firstly, to process your order and second, to provide you with the best
possible service.
We collect the information you supply to us through
enquiry and registration forms, and every time you e-mail us. We will
never collect sensitive information about you in any other way without
your explicit consent.
We will not e-mail you with marketing information in the future unless you
have given us your consent.
The type of information we will collect about you
includes:
- your name
- address
- phone number
- email address
When you place an order through our web site such information is securely transmitted to and may be
retained by WorldPay plc. WorldPay may collect your credit card details
and pass them, together with information such as that specified above, to payment card processors and
banks in order to validate your credit card. WorldPay's privacy policy is
stated here.
Our site does not itself collect your credit card
details, and therefore we do not have any record of these details on our
web site or at our premises.
The information we hold will be accurate and up to date.
You can check the information that we hold about you by emailing us. If
you find any inaccuracies we will delete or correct it promptly.
The personal information which we hold will be held
securely in accordance with our internal security policy and the law.
If we intend to transfer your information outside the
EEA (European Economic Area) we will always obtain your consent first.
WorldPay may transfer your information outside of the EEA.
We may use technology to track the patterns of behaviour
of visitors to our site. This can include using a "cookie" which
would be stored on your browser. You can usually modify your browser to
prevent this happening. The information collected in this way can be used
to identify you unless you modify your browser settings.
Other than for the purposes of payment transactions as
stated above, we will not pass your information to any third parties
unless you have agreed that we can.

Mistakes and complaints
Mistakes in bills, receipts or payments
We will correct any mistakes in bills, receipts or payments
as soon as possible, and at the latest within 30 days of agreeing to do
so.
Complaints
If you have a complaint, please
contact us. Our policy is to:
- Acknowledge complaints within 5 working days
- Advise you how long it will take to resolve the
complaint
- Keep you informed throughout the process.
Security
We do not retain any information about you or your credit
card details on our site. When you fill in the payment form, your details
are encrypted and sent to WorldPay.

Using industry standard
SSL, Thawte and WorldPay unique encryption systems, this is not
actually the case. When you fill in the payment form and click
the submit button, your details are not sent straight away.
What actually happens is that a secure link is set up between your
browser and WorldPay and an encryption code is requested and
received, which then wraps the order and transaction details before
leaving your premises. |
